    Dear sir/madam
My application for leave to remain dated 31/Oct/2009 has been refused as I had not provided my BSc certificate (which I have) and not shown the money (which I think I can show). In my appeal:
    1. Should I give bank statement for the month before my initial application (Sep-Oct 2009) or should I give the last month’s bank statement?
    2. As my initial application was before 1 Feb 2010, is it still enough to show that I had the money on the day of my application?
    3. Would it make the case stronger if the appeal is through a solicitor?
    Regards
    Vida Ghaforian

  5. Yupawadee Thavornanumas says :

    Dear Sir,

According to the UK VISA extension application. My friend was applied for student visa extension on 30-09-09 but it was refused due to false information.

Firstly, It was indicated by Home Office that he had claimed 30 points for a visa letter issued by London College of **** which was not listed under the Tier4 Sponsor Register. But in fact, His visa letter was not issued by this school but it was issued by **** College which has been on The Tier 4 Sponsor register.
(London College of *****; Sciences was his ex-school that he had already finished course since August)

Secondly, he has claimed 10 points for funds under Appendix C of the immigration rules, but the document he had provided were not stamped by the bank and maintenance could not be assessed correctly as he had not submitted a valid visa letter, they couldn’t determine how much money he would be required to have in his bank account. In fact, he had already submitted his visa letter which showing how much he had paid toward his course fees and it had been paid in full. The applicant was in fact required to have only £1,600 in respect of 2 months maintenance. He had
£3,000 on the date of his application so he had met the rules to be granted leave to remain as a Tier 4 ( General) Student Migrant.

Could you please give me the best possible advice to appeal this case as deadline to appeal is on 27 November?
(His visa was expiring on 30-09-09 and he got refusal letter on 11-11-09)

Is there any chances for my friend to make an appeal?
Can he appeal this case himself by giving them some more supporting evidence and the letter enclosed explaining what the mistakes was without asking the letter from solicitor?

Can he fill the appeal form himself?

Thank you very much for your consideration and your time, I will be appreciated.

    Best Regard,

    Yupawadee Thavornanumas
