The UK Border Agency has published information to clarify the position for old student visa holders still in the UK under a pre-Tier 4 status.
The advisory page explains what you should do if you are currently in the UK as a student under the Immigration Rules that were in place before 31 March 2009.
If you are an old student visa holder you will retain the terms and conditions of your stay in the UK associated with the old rules, until your current permission to stay expires.
But if you want to extend your stay in the UK as a student, you will need to apply to us under Tier 4 of the points-based system.
Part 3 of the Immigration Rules and chapter 3 of our immigration directorate instructions contain more information on the old rules. You can find both of them under ‘Policy and law’ on the border agency website.
