Another entry clearance (student visa) refusal reversed by the repsondent British Embassy in Manila following an appeal to AIT (Asylum and Immigration Tribunal).

Immigration Adviser Bison UK lodeged the entry clearance appeal six months ago after the Filipina student was unlawfully refused a visa to study for an NVQ course at Majestic College in London.

Shortly before the appeal hearing, the Entry Clearance Manager withdrew the original refusal and issued the 3 year student visa within a week.

The Filipina student has now reported to her UK educational provider, Majestic College (www.majesticcollege.org), to start her NVQ Health and Social Care course, which runs alongside paid work placement arranged by Bison UK.

Visa appeals have been abolished for student visa refusals in line with new ‘points based’ rules. Students refused entry clearance under Tier 4 of the points based system, which took effect on 31 March 2009, will now have their cases reviewed by an ECM under the new ‘Administrative Review’ system.

    hi my student visa application waa refused last month, and i applied for administrative review last week. my agency said i dont need to resubmit my documents. so how do the UK embassy review my refusal/application if i didnt submitted my documents like bank cert, etc etc…

    Sir, My application as student visa was refused last January 14, 2009 by the ECO. and my appeal was submitted last February 5, 2009. Now the UK Embassy Manila informed me thru post mail, and also i have receive a letter from Asylum and Immigration Tribunal last November 13, 2009. Stating the letter, You have indicated that you want the appel to be decided on the papers without a hearing.

    Now, My question is there any possible effect the new rule for student visa under the PBS? since my application is not under the PBS. and my appeal was no yet result?

  3. The Administrative Review (not appeal) is a new procedure. You should follow this up with the British Embassy ECM who will be carrying out the review.
