Two private colleges have been granted permission to apply for a judicial review (JR) of the Secretary of State for the Home Department (SSHD’s) decisions to suspend and then revoke their licence to sponsor Tier 4 students.
Hon. Mr Justice Nicol in the Admin Court has also granted interim relief to AA Hamilton College and Leeds Professional College that their licences are restored pending the hearing of the application for JR.
SSHD had arguably required of the college’s action, in managing their Tier 4 students, which was not required under the then relevant Tier 4 guidance. And had arguably fettered his discretion in deciding that he must suspend in circumstances where his discretion meant this was merely an option. SSHD had failed to give adequate reasons for the suspension of one of the colleges. Source ILPA.
